Why Obama’s birth certificate does matter

December 4th, 2008 Posted in Libtards, WTF

Found this over at Brutally Honest and thought I should share it.  Everyone who thinks Obama’s birth certificate is a dead issue and will just fade away now that the election is over may want to think again according to constitutional lawyer Edwin Vieira:

“Let’s assume that an Obama administration passes some of these controversial pieces of legislation he has been promising to go for, like the FOCA (Freedom of Choice) Act,” said Mr. Vieira. “I would assume that some of those surely will have some severe civil or criminal penalties attached to them for violation. You are now the criminal defendant under this statute, which was passed by an Obama Congress and signed by President Obama. Your defense is that is not a statute because Mr. Obama is not the president. You now have a right and I have never heard this challenged, to subpoena in a criminal case, anyone who has relevant evidence relating to your defenses. And you can subpoena them duces tecum, meaning ‘you shall bring with you the documents.’ “

So, maybe we will get an answer to the question after all.  I know that Obama’s lawyers have managed to dodge the bullet on this one, but I think they may be coming to the end of the line with Alan Keyes’ lawsuit.

The sad part about this is that this is a question that should have been answered long before a person is even allowed to toss their hat into the ring.  Am I to just assume that all that a candidate had to do was say “Yep, I was born here” and no verification is ever done on the documents?  Good Lord, I have to provide more documentation that just my given word to even get a drivers license, but you don’t have to prove anything to be POTUS?

“Let’s assume he wasn’t born in the U.S.,” Mr. Vieira told The Bulletin. “What’s the consequence? He will not be eligible. That means he cannot be elected validly. The people and the Electoral College cannot overcome this and the House of Representatives can’t make him president. So what’s the next step? He takes the oath of office, and assuming he’s aware he’s not a citizen, then it’s a perjured oath.”

Perjured oaths?  Well, the democrats should be very familiar with that.

Is it just me or does politics in general show what stupid people in large numbers can accomplish?

Oh, and there’s this comment which shows the truly ignorant stance of some Obama supporters

McCain birth certificate has never been shown to the public. Is it because he is “white” the reason why he is never questioned? When this group when nuts after realizing a black man could be president they got Keyes, one man pissed at himself for not being born white to take up their cause of ignorance. You will always find a black pissed of man to go along with bias and hatred.

Say it with me everyone:  “RAAAAAAACISM!”

How to get the Vault Birth Certificate of the President Elect

Over a dozen lawsuits have been filed most of which are hinged on forcing the President Elect to show his “Vault Birth Certificate”. So far, the lower courts ruled that none of the plaintiffs, as US citizens, have “standing” to enforce the Constitution, as they can not prove harm. State officials take the stance that checking eligibility for presidency is not their duty. One Elector made a public statement to the effect that the current administration had ample opportunity, so he is counting on them to check the eligibility of the President Elect. In the meantime, the White House would not touch the issue with a ten-foot pole. The mainstream media largely avoids the topic or dismissing it as fanciful conspiracy theory, instead of questioning why the President Elect spent hundreds of thousands on legal fees to keep it secret. Even most conservative talk show hosts, with few exceptions, avoid the issue or touch it on surface only. There is silence from the GOP as well.

In many states one must show a valid birth certificate for fishing or driver’s license, or for receiving social security benefits, but a simple statement of eligibility by the candidate is sufficient to be president, similarly to a “no-doc real estate loan”.

Suggestion: As US citizens have no “standing” because they can not prove harm, let’s ask one of the Guantanamo Bay prisoners to file a lawsuit. The courts have been enthusiastically granting these foreign dudes “standing” at US courts. A good attorney could claim that the President Elect appears to be less determined to dismantle GITMO than promised in his campaign, thereby causing irreparable harm to the terrorist. No doubt the court will order the “Vault Birth Certificate” promptly.

The saddest part about your idea is that it would probably work.
